Apps Privacy Statement

Introduction

Your privacy is important to The Math Learning Center (“MLC,” “us,” “our,” and/or “we”). This Privacy Statement describes our information and privacy practices that apply when you use MLC’s Apps, including but not limited to: Fractions, Geoboard, Math Vocabulary Cards, Money Pieces, Number Frames, Number Line, Number Pieces, Number Pieces Basic, Number Rack, Pattern Shapes, and Partial Product Finder (collectively, the “Apps”). Versions of the Apps accessed from a common Web Browser are referred to as “Web Apps”. For purposes of this Privacy Statement, the Web Apps and apps for mobile devices are collectively referred to as the “Apps,” and the term “App” means one or more or all of the Apps.

PLEASE READ this Privacy Statement before you use the Apps. Your use of the Apps signifies that you have read and agree with all of the terms of this Privacy Statement and consent to the collection and use of your personal information by MLC, as described in this Privacy Statement. If you do not agree with any part of this Privacy Statement, do not use the Apps. If you are acting on behalf of an entity, you represent that you have full authority to bind your entity to this Privacy Statement. If you do not have such authority, do not use the Apps.

We reserve the right to update and revise this Privacy Statement at any time. We will post any new or revised Privacy Statement here, and you should review this Privacy Statement regularly to make sure you are aware of its terms. You can determine whether this Privacy Statement has been revised since your last visit by referring to the Last Updated date at the top of this page. If changes are significant, we may, but are not required to, also notify you of such changes to this Privacy Statement by posting a notice on the homepage of the Apps. Your use of the Apps following such revision constitutes your acceptance of and agreement to the terms of this Privacy Statement as amended by us, and the revisions will apply to Automatically Collected Information (described below) collected on and after the date on which we post the revised Privacy Statement.

Information Collected

A. Personally Identifiable Information

No Personally Identifiable Information is collected in order to access, or during the use of, the Apps. We do not send marketing communications to App users as a result of their use of the Apps because the Apps do not collect Personally Identifiable Information that we could use to contact the user. B. Automatically Collected Information (Web Apps Only)

When you use the web apps, we may use Google Analytics (third-party cookie discussed below) to track Web App usage information, such as the type of web browser used to access and use the Web App; usage information such as date and time of visit, duration of visit, and Web App features used; regional location of the user combined with regional location of all other App users, provided to us in aggregate form; and other similar Automatically Collected Information. When you use the Web Apps, we do not collect any Personally Identifiable Information. Further, we do not use the Automatically Collected Information of Web App users for any purpose other than for the internal business purposes of learning what Web Apps are most popular and improving our Web Apps and related services. Please see additional information below regarding our use of Google Analytics to track Web App usage. 

How We Collect Automatically Collected Information (Web Apps Only)

A. Cookies and LocalStorage

Some of the Web Apps uses a feature of your web browser called LocalStorage. LocalStorage is similar to web “cookies” in that it places data within the web browser on your hard drive (for example, outlines you might save in the My Saved Outlines feature of the App) and assigns you a unique, random, anonymous ID to facilitate use of that data within the Web App. Standing alone, this data does not identify Personally Identifiable Information of a user; rather, it identifies data used to restore the last used values by anyone using that web browser to access the app. You remain anonymous to us when using any or all of the Web Apps.

Most web browsers automatically accept cookies (including LocalStorage), but you can disable the acceptance of this data at any time by changing the preferences in your web browser. Please refer to your web browser for information on how to disable and control cookies. If you choose to disable cookies on your browser, you may not be able to use some of the features or services offered on the Web Apps or some features or services may not function as well. If cookies are enabled on your browser, you should assume that Automatically Collected Information is constantly being gathered by every website you visit, including the Web Apps.

B. Automatically Collected Information Provided to Us by Google Analytics

When you use our Web Apps, Google Analytics may collect ‎information automatically from you through the use of Google’s analytics IDs. An analytics ID is a specific string of numbers and letters (often called a “character string”) that is assigned to your computer or device but does not name you. The analytics ID allows Google to track data regarding your use of our ‎Web Apps. Google Analytics provides this information to us, but all information provided to us will be in aggregate form ( i.e. , data about many Web App users combined and not just about you) and will be about the use of our Web Apps. Some of this data might include the geographic location of Web App users, but again, this data will be in aggregate (and not individual) form. We might use information we receive from Google Analytics to learn how users are using the ‎Web Apps and to improve the Web Apps.‎ When you use one or more of our Web Apps, we will not collect or receive any Personally Identifiable Information about you, and we will not receive the analytics ID assigned to your computer or device that you use to access and use the Web Apps.

C. IP Addresses

When you access the Web Apps, we collect your Internet Protocol (“IP”) address to track and aggregate Automatically Collected Information. For example, we use IP addresses to monitor the usage of our Web Apps in different geographic regions.

Use of Collected Information (Web Apps Only)

We may use both Automatically Collected Information to help diagnose problems with the Web Apps; to analyze statistical use patterns and demographic data; and to improve the apps and our websites, products, and services.

Please note that we may aggregate Automatically Collected Information as you use one or more of our Web Apps, and may separately also aggregate Automatically Collected Information or Personally Identifiable Information as you use our other websites. In these cases however, Automatically Collected Information is not un-aggregated; that is, we cannot use the Personally Identifiable Information to identify the Automatically Collected Information.

When you use our Web Apps, we collect Automatically Collected Information in an effort to ensure that our App will appear and function appropriately on your web browser, to help us improve the Web Apps, and so we may determine what website referred you to our Web Apps. We may also use Automatically Collected Information to track what our Web App users are looking at most frequently so we can recognize and deliver more of the desired features, products, and services. Who Has Access to the Information We Collect?

We may share de-identified aggregated Automatically Collected Information without restriction with third parties as described below. The Apps do not collect Personally Identifiable Information. A. Third-Party Service Providers

We may provide your Automatically Collected Information (collected only by the web apps, as described above) to third parties that provide us with services to the extent necessary and appropriate, in our discretion, to perform certain services on our behalf (e.g., improving App-related services and features, conducting App analytics). These third parties are not authorized to use your Automatically Collected Information for any other purpose and are required to keep the information confidential.

B. Merger, Acquisition, or Sale

We may transfer any and all Automatically Collected Information to a third party (whether affiliated or not), in the event of a sale or transfer of assets or other disposition of all or any portion of our business. In this event, we will, if allowed, use reasonable efforts to notify you when Automatically Collected Information is transferred to any third party under this paragraph by posting such notice on MLC’s website at www.mathlearningcenter.org .

C. Required by Law

Notwithstanding anything to the contrary in this Privacy Statement, we may also use and/or disclose Automatically Collected Information to any third party, without your consent and without notice to you, if we believe we are legally obligated to do so; if we believe disclosure is necessary to protect, establish, or exercise our legal rights or defend against legal claims; or if we believe disclosure is necessary to protect our other customers, third parties, or our employees, property, or business.

This Privacy Statement applies only to the Automatically Collected Information collected through the Apps. The Apps may contain links to other websites (“Linked Sites”), products, and services that are not owned or controlled by us. We are not responsible for and have not reviewed the privacy practices of the Linked Sites, or the owners or operators of the Linked Sites, products, or services. The owners and operators of the Linked Sites, products, or services may have their own policies regarding privacy and security. You should review any Linked Sites, products, or services for their own privacy practices to determine what information about you may be collected and used when you use such Linked Sites, products, or services.

Severability

If any part of this Privacy Statement is determined to be invalid or unenforceable pursuant to applicable law, then the invalid or unenforceable provision will not affect the validity and enforceability of any other provision.

Student Privacy Notice

Because no Personally Identifiable Information is tracked, collected, identified, stored, or transmitted, the Apps are FERPA and COPPA compliant.
